1. Acceptance of These Terms
By using the StormLightning website, requesting a quotation, or engaging StormLightning for services, you agree to these Terms of Service. If a written quotation, scope of work, service agreement, or invoice contains terms that differ from these website terms, the terms in the applicable written document will take priority for that specific work.
2. Services and Quotations
StormLightning provides lightning conductor installation, lightning protection systems, earthing repairs, inspections, servicing, maintenance, and related work. Information on this website is general. The final scope, price, timing, materials, exclusions, and deliverables for a job will be confirmed in a quotation or other written communication. Quotations may be subject to a stated validity period and may change if site conditions, access requirements, client instructions, or the agreed scope changes.
3. Site Access and Client Responsibilities
The client is responsible for providing safe and reasonable access to the property or work area at agreed times and for disclosing known hazards, access restrictions, underground or concealed services, structural concerns, or other information that could affect the work. Delays or additional work caused by undisclosed conditions or restricted access may result in revised timing or charges.
4. Pricing and Payment
Prices, deposits, payment stages, and due dates will be set out in the relevant quotation, invoice, or agreement. Unless otherwise stated in writing, additional work outside the agreed scope may be quoted or charged separately. StormLightning may pause or withhold work, documentation, or completion where agreed payments are overdue, subject to applicable law.
5. Cancellations and Rescheduling
Requests to cancel or reschedule confirmed work should be made as early as possible. Costs already incurred for materials, special orders, travel, bookings, labour allocation, or completed work may remain payable where permitted by law and where relevant to the cancellation.
6. Inspections, Certification and Existing Systems
Any inspection, maintenance, repair, or certification is based on the condition and accessibility of the system at the time of the work. StormLightning cannot be responsible for concealed defects, unauthorised changes, damage occurring after completion, or components and work outside the agreed scope. Certification, where applicable, relates only to the work or system assessed and documented.
7. Warranties and Liability
StormLightning will perform agreed services with reasonable care and skill. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded under South African law. To the extent permitted by law, StormLightning is not liable for indirect, incidental, special, or consequential loss arising from website use or from circumstances outside the agreed scope or reasonable control of StormLightning.
8. Website Information
We aim to keep website information accurate and current, but descriptions, images, availability, and other content may change without notice. Website content does not replace a site assessment, written quotation, technical specification, or professional advice for a particular property.
9. Intellectual Property
Unless otherwise stated, the StormLightning name, branding, website design, text, graphics, photographs, videos, and other website content are owned by or licensed to StormLightning. They may not be copied, reproduced, republished, or used commercially without prior written permission, except where permitted by law.
10. Acceptable Website Use
You may not use this website to interfere with its operation, attempt unauthorised access, submit malicious code, impersonate another person, send unlawful or abusive content, or use the website in a way that violates applicable law or the rights of others.
11. Third-Party Links
Links to third-party websites or services are provided for convenience. StormLightning does not control and is not responsible for third-party content, availability, terms, privacy practices, or security.
12. Governing Law
These terms are governed by the laws of the Republic of South Africa. Any dispute will be dealt with in accordance with applicable South African law and the jurisdiction of the appropriate South African courts or other lawful dispute-resolution processes.
13. Changes to These Terms
StormLightning may update these Terms of Service from time to time. The current version will be published on this page and will apply from the date shown above, except where a separate written agreement governs existing work.
